Δικηγορικό Γραφείο ΑθήναMediation is a negotiating process between two or more parties, which is assisted by a third party, namely an accredited mediator, aiming at resolving a conflict extra-judicially, so that the time-consuming and expensive procedure before the courts may be avoided. The parties are driven on their own with the assistance of the mediator, who is especially trained and qualified, and the support of their authorized attorneys, to an agreement towards the settlement of their dispute which following its execution is fully binding upon the parties and is enforceable in accordance with the rules of Greek Civil Procedure on enforcement of judgments or on general enforceable documents. All private law disputes may be subject to mediation provided the parties have power of disposal over the subject matter of the dispute and are willing to resolve the same through mediation.

Moreover, in addition to the above, Law 4640/2019 provides for an obligatory stage of mediation, called the Obligatory Initial Session (OIS), that is one meeting between the parties along with their attorneys before the mediator, in order to consider whether they may resolve their specific dispute by having recourse to mediation. This applies to family law cases (with the exception of divorce cases, cases of marriage annulment, disputes arising from the relation between the parents and the children etc.), to cases where the subject matter exceeds the amount of 30,000.00€ which, if they were to be brought before the courts, they would be subject to the ordinary procedure of the Single-Member and Multi-Member First Instance Court, as well as to cases where the parties have agreed that  should there arise a dispute among them, they will  endeavor  to settle the said dispute  through mediation prior to having recourse to the courts (mediation clause). This meeting may take place at any time and in any case prior to the hearing of the case before the court. Following the conclusion of such meeting, the parties, if they choose to do so, may finally submit their dispute to mediation and have it successfully resolved.
